Welcome to BAiQ (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, platform, and related services (“Services”). By creating an account, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use BAiQ.
1. Eligibility
You must be at least 18 years old and authorized to act on behalf of your organization to use our Services. By registering for BAiQ, you confirm that you meet these requirements.
2. Accounts
To access certain features, you must create an account and provide accurate information.
You are responsible for maintaining the security of your login credentials and for all activity under your account.
Notify us immediately if you believe your account has been compromised.
3. Acceptable Use
You agree to use BAiQ only for lawful purposes and in compliance with these Terms. Specifically, you may not:
Upload or share false, misleading, or unlawful data.
Attempt to interfere with or disrupt the platform’s security or functionality.
Copy, reverse engineer, or misuse our Services or content.
Use BAiQ in a way that competes unfairly or violates intellectual property rights.
4. Data Rights & Benchmarking
Your Data: You retain ownership of any data you upload (plan booklets, renewals, CRM information, etc.).
License to Use: By uploading, you grant us permission to process, anonymize, and aggregate your data for benchmarking.
Aggregated Insights: All reporting is anonymized. Individual organizations will never be identifiable.
Data Deletion: You may request deletion of uploaded files, though aggregated insights will remain anonymized.
5. Membership & Payments
Pricing and membership plans are listed on our website.
Payments are due according to your chosen plan (annual or monthly).
Fees are non-refundable except where required by law.
We may adjust pricing in the future, with notice provided before changes take effect.
6. Intellectual Property
BAiQ, its technology, design, and content are our exclusive property and protected by intellectual property laws.
Except as expressly authorized, you may not reproduce, distribute, modify, or create derivative works of BAiQ content or software.
7. Confidentiality
We treat your data as confidential and will not disclose it except as outlined in our Privacy Policy. You agree to respect the confidentiality of BAiQ’s proprietary information.
8. Disclaimers
BAiQ provides benchmarking insights for informational purposes only.
We do not guarantee that reports are error-free, complete, or suitable for every decision-making need.
The Services are provided “as is” without warranties of any kind, either express or implied.
9. Limitation of Liability
To the maximum extent permitted by law, BAiQ and its directors, officers, employees, and affiliates shall not be liable for:
Indirect, incidental, or consequential damages.
Loss of data, profits, or business opportunities.
Claims exceeding the total amount paid by you for Services in the 12 months prior to the claim.
10. Termination
We may suspend or terminate your account if you:
Breach these Terms, or
Use the platform in a way that harms BAiQ or its community.
You may terminate your account at any time. Sections on confidentiality, payments, intellectual property, and liability survive termination.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and applicable Canadian federal laws, without regard to conflict of law principles.
12. Updates to Terms
We may revise these Terms from time to time. Updates will be posted on this page, and continued use of BAiQ after changes constitutes acceptance.
